The Will of George H. Hazelbaker

The following was collected and transcribed by Jill Hazelbaker Foley, a Family Historian and great contributor to this site.  It is the will of George Hazelbaker, one of the sons of the original Peter.  As an amateur Hazelbaker historian, I find the reference to J.S. Van Voorhis as a good friend to George interesting and valuable.  Van Voorhis was an important historian of the area. This implies that his references to the hazelbakers in his work are reliable.

I also found it interesting, and unexplained to me, why George would drop his son George W. as an executor of the will.  Did George W. die or fall from favor?  I am sure someone will know and tell us.

Will of George Hazelbaker

Know all men by these present, that I, George Hazelbaker, of Allen Township in the County of Washington, State of Pennsylvania, farmer, being in ill health, but of sound and disposing mind and memory, do make and publish this, my last will and testament, hereby revoking all former wills by me at any time heretofore made.
And as to my worldly estate, and all the property, real, personal, or mixed, of which I shall die, seized and possessed or to which I shall be entitled at the time of my decease, I devise, bequeath, and dispose thereof in the manner following to wit:
First, my will is that all my just debts and funeral expenses shall, by my executors hereinafter named, be paid out of my estate as soon after my decease as shall, by them, be found convenient.
Item.  My will is that within one year after my decease that my real and personal estate shall be sold and the proceeds thereof together with whatever I may possess, be equally divided, share and share alike, between and among my children, Anthony Hazelbaker, Jacob Hazelbaker, Mary Cooper, George W. Hazelbaker, Matilda Wolf, Margaret Guffey, Sarah A. Cummins, John Hazelbaker and my grandson, Thomas B. Hazelbaker son of my deceased son Andrew Hazelbaker.
And lastly I do nominate and appoint my friend Dr. J.S. Van Voorhis and my son, George W. Hazelbaker, to be the Executors of this, my last will and testament.
In testimony whereof I, the said George Hazelbaker, have to this, my last will and testament, subscribed my name and affixed my seal this ninth day of March in the year of our Lord, one thousand eight hundred and seventy-two

I, George Hazelbaker, hereby add the following codicil to my last will and testament,
viz. I direct my Executor to pay my daughter’s share, that one named, Margaret Guffey, to the others, viz. Anthony, Jacob Hazelbaker, Mary Cooper, Matilda Wolf, Sarah A. Cummings, Geo. Hazelbaker, John Hazelbaker and my grandson, Thomas B. Hazelbaker, son of my deceased son Andrew Hazelbaker, to be paid to each share and share alike, and I hereby appoint my friend, Dr. J.S. VanVoorhis, my sole executor of my last will and testament and of this codicil, hereby revoking the appointment of my son Geo. W. Hazelbaker, as one of my executors.  In testimony whereof I, George Hazelbaker, the testator have hereunto subscribed my name and affixed my seal this eighth day of June A.D. 1880

            Be it remembered that upon this 30th day of June, 1880 before me, W.H. Underwood, Register for the Probate of Wills and granting letters of Administration within, and for, said county, came Dr. J.S. VanVoorhis and James Reynolds, two of the subscribing witnesses to the foregoing attached will of George Hazelbaker deceased, who, after being duly qualified according to law, depose and say, that they were present at the execution of said will – saw the testator sign the same by affixing his mark – heard him publish it as, and for, his last will and testament;  that they, at his request, in his presence, and in the presence of each other, subscribed their names thereto as, witnesses
